Circuit Court Sentencing Orders - September 13, 2022

Hannah J. Leathers, 2000, pleaded guilty to Count Two, possession of drug paraphernalia, a Class A misdemeanor, sentenced to 12 months prison; Count Three, public intoxication, a Class B misdemeanor, sentenced to 90 days prison. Defendant's sentence is conditionally discharged for a period of two years subject to the same terms and conditions of PreTrial Diversion. Defendant must pay $500 public advocacy fee and $165 court costs but court waives fines. Defendant shall begin making payments on amount during immediately upon release. Balance must be paid in full by Feb. 23, 2023. Any cash bond posted may be refunded and/or any property bond released.

Julia Carol King, 1984, 22-CR-00035, pleaded guilty to Count One, possession of a controlled substance in the first-degree, third or subsequent offense, a Class D felony, sentenced to 1 year prison; Count Two, possession of drug paraphernalia, a Class A misdemeanor, sentenced to 12 months prison. Sentences to run concurrent for 1 year. 22-CR-00086, pleaded guilty to Count One, bail jumping in the first degree, Class D felony, sentenced to 5 years prison. Sentence in 22-CR-00086 shall run consecutive to the sentence in 22-CR-00035 for 6 years prison. Sentences shall run consecutive to any backup sentence. Defendant shall pay public advocacy fee of $500 and court costs of $165 in both cases but court waves fines. Defendant is placed on probation under supervision of Division of Probation and Parole of the State of Kentucky for 5 years from the date of release and must meet all conditions. Defendant shall pay a supervisor fee of $300 through the Carroll Circuit Court in both cases, shall pay a public advocacy fee of $500 through the Carroll Circuit Court in both cases and shall pay court costs of $165 through the Carroll Circuit Court in both cases. Amanda L. Frazier, 1980, pleaded guilty to Count One and Count Two, flagrant non-support, a Class D felony, sentenced to 5 years on each count. Sentences shall run concurrent for one 5 year sentence, sentence shall run consecutive to any backup sentence. Defendant must pay $500 public advocacy fee and $165 court costs but court waves fines. Defendant is placed on probation under supervision of Division of Probation and Parole of the State of Kentucky for 5 years from the date of release and must meet all conditions. Defendant shall pay amount of $10,678.454 within 5 years of probation or shall remain on probation until said arrears are paid in full; defendant shall pay $2,539.63 in arrears within 5 years probation or shall remain on probation until said arrears are paid in full. Defendant shall pay a supervision fee of $300 through Carroll Circuit Court, shall pay a public advocacy fee of $500 through Carroll Circuit Court, shall pay court costs of $165 through Carroll Circuit Court. Winston B. Coyle, 1996, pleaded guilty to Count One, receiving stolen property value over $1,000 but less than $10,000, a Class D felony, sentenced to 4 years prison; Count Two, criminal mischief in first-degree, a Class D felony, sentenced to 4 years prison, sentences to run concurrent for one 4 year sentence. Sentence shall run consecutive to the sentence in Boone Circuit Court and any other backup sentence, defendant shall pay public advocacy fee of $750 and court costs of $165, court waives fines. Starks, 1989, pleaded guilty to Count One, possession of controlled substance first-degree, third or subsequent offense, Class D felony, sentenced to 18 months prison; Count Two, possession of drug paraphernalia, Class A misdemeanor, sentenced to 12 months prison; Count Three, possession of controlled substance in third-degree, first offense, Class A misdemeanor, sentenced to 12 months prison; Court Four, possession of marijuana, Class B misdemeanor, sentenced to 45 days, sentences to run concurrent for one 18 month  sentence, sentence shall run consecutive to any backup sentence. Defendant shall pay public advocacy fee $250, court costs $165, court waives fines. Balance to be paid in full by May 22, 2023. Carroll 22-CR-0006, pleaded guilty Count One, assault in third-degree, Class D felony, 5 years prison; Count Two, promoting contraband in first-degree, Class D felony, sentenced to 5 years; Count Three, possession of a controlled substance in the first-degree, first offense, Class D felony, sentenced to 3 years; Count Four, possession of drug paraphernalia, Class A misdemeanor, sentenced  to 12 months prison; Count Five, possession of a controlled substance in the third degree, first offense Class A misdemeanor, sentenced to 12 months. Carroll 22-CR-00084, Count One, bail jumping in first-degree, Class D felony, sentenced to 5 years; sentence in Carroll Circuit 22-CR-00084 and Carroll Circuit 22-CR-00006 shall run concurrent to each other but consecutive to sentence in Owen Circuit 22-CR-00003 for one 10 year prison sentence. Defendant shall receive credit for time spent incarcerated pending sentencing. Defendant shall pay public advocacy fee $750, $300 supervision fee, court costs of $165 in all cases, but court waves fines. Defendant is placed on probation under supervision of Division of Probation and Parole of the State of Kentucky for 5 years from the date of release and must meet all conditions. Defendant admits to having a serious substance abuse addiction and is requesting inpatient resident substance abuse treatment and shall remain incarcerated pending a bed date. Balance to be paid in full by June 13, 2023. Any cash bond posted may be refunded and/or any property bond released.
